Among other features, this platform includes a range of tools for traders to build and customize their physical stores to online stores/e-shop, manage products, inventory, payments, fulfillment, business operations, marketing and advertising, and engage with existing and potential customers; making it easy for everyone to do business anywhere.
  Your access and use of our website and mobile applications, as well as any service or content are governed by these Terms. You must read, agree with and accept all of the terms and conditions contained or expressly referenced in these Terms and Conditions of Use. This includes the User Privacy Policy and the Cookie Notice. If you do not agree with these general Terms and Conditions or any part of these laid out Terms and Conditions, you must not use our platform.

• The Administrator itself is not an importer, manufacturer, distributor, or seller of any item, as well as not a provider of any service posted by users on the Platform. Unless otherwise expressly provided, Mubbi has no control over and does not guarantee: the existence, quality, safety, or legality of items advertised; the truth or accuracy of users' content or listings; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

2. USAGE & ACCOUNT REGISTRATION

To access and use most of our services, you must register for a Mubbi Account

• You may not register with our platform if you are under 18 years of age (by using our marketplace or agreeing to these general terms and conditions you warrant and represent to us that you are at least 18 years of age)

• In order to use certain features of our services you may need to register an account on the platform and provide certain information about yourself as prompted by the registration form. Example, your full legal name, business address, phone number, a valid email address.

• You may create an Account as an individual or as an authorized representative of a company

• You acknowledge that you are solely responsible for safeguarding and maintaining the confidentiality of access details to your Account and that you are fully responsible and liable for any activity performed using your Account access details. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

• We reserve the right to suspend or terminate your Account, or your access to the Service, with or without notice to you, in the event that you breach these Terms and Conditions of Use.

• In the event of a dispute with regard to Account ownership, we reserve the right to request re-verification to determine or confirm Account ownership. • We strive to create a marketplace where buyers easily find what they are looking for. Therefore, the appearance or placement of listings in search and browse results will depend on a variety of factors such as buyer's preference, price and shipping cost, and relevance to user query.

• When listing items for sale on your e-shop, you agree to comply with our Listing policies and also agree to the following:

  • You assume full responsibility for all items offered and the authenticity and content of listing, including listing content created using tools offered by Mubbi or third parties such as translation, image editing, or other generative artificial intelligence tools.

  • Reported content would be duly reviewed and appropriate measures taken to ensure best practices in such regard. Similarly, reported accounts would undergo review and could be suspended, banned or deleted.

  • Content that violates listing policies and conditions may be modified or deleted at our sole discretion.

ADS' PLACEMENT POLICY

To ensure a smooth experience for both sellers and buyers, Sellers are advised to note the following while uploading items on Mubbi:

• Provide accurate and detailed description: Provide an accurate and comprehensive description of the item being uploaded. Include information such as brand, size, color, condition, and any other relevant details. Make sure to mention any flaws or defects, if applicable.

• Use high-quality images: Upload clear and high-resolution images that accurately represent the item. Include pictures from different angles and zoom in on any important details or flaws. Do not use images downloaded online or low-quality photos as it can mislead buyers.

• Authenticity and originality: Only upload items that are genuine and original. Do not sell counterfeit or replica products, as it violates the terms of the Mubbi platform.

• Pricing transparency: Clearly state the item's price, including any applicable taxes or additional charges. Avoid misleading buyers with hidden costs or deceptive pricing strategies.

• Condition and usage disclosure: Clearly mention the item's condition, whether it is new, used, or refurbished. Describe the level of usage or wear and tear, and disclose any minor or major damages. Honesty is crucial to maintain trust with potential buyers.

• Prohibited items: Familiarize yourself with the list of prohibited items on Mubbi. Ensure that you do not upload items that violate these rules. Common examples include weapons, drugs, counterfeit goods, adult content, stolen items, or any other illegal or inappropriate products.

• Compliance with local regulations: Adhere to local laws and regulations as applicable in Nigeria when uploading items.

• Copyright and intellectual property: Respect intellectual property rights and do not upload items that infringe on copyrights, trademarks, or patents. Avoid selling unauthorized copies of branded products or using copyrighted images without permission.

• Banned or recalled items: Avoid selling items that have been banned or recalled by relevant authorities. Stay up-to-date with product recalls or any safety concerns to ensure that you do not upload such items onto the online market platform.

• Terms and conditions: Clearly outline your terms and conditions, including return policies, payment method accepted, and any other relevant information to buyers.

• Feedback and communication: Maintain open and timely communication with potential buyers. Promptly respond to inquiries, provide additional information if requested, and act professionally throughout the transaction process. Encourage buyers to leave feedback after the transaction is complete.

Whenever you notice any item that violates Mubbi policies, please report by clicking the Report Item link, or by reaching us through our Contact Us page. Such items would be pulled down and all parties concerned are notified immediately.

PROHIBITED ITEMS

The following presents a list of items that are prohibited and forbidden for upload by sellers on the Mubbi marketplace:

• Weapons and firearms

• Stolen goods or items of unproven sources

• Counterfeit or fake products

• Illegal drugs or drug paraphernalia

• Adult content or pornography

• Materials that exploit or abuse children

• Items that violate intellectual property rights, such as counterfeit software, pirated movies or pirated brand-name goods

• Poached animal materials and other wildlife products

• Explosives or hazardous materials

• Prescription drugs or controlled substances

• Products that promote violence or hate speech

To ensure that the Mubbi community is safe for everyone, Sellers are advised to adhere to all terms and conditions of use of Mubbi. Penalties for posting of prohibited items on the Mubbi platform could range from temporary to permanent suspension of accounts. Applicable local laws against exhibition and sales of such items could also apply.

5. PURCHASE CONDITIONS

The purchase conditions also apply to all users - sellers and buyers alike; all purchase terms and conditions are exemplified for easy understanding

• When purchasing an item on the Mubbi Marketplace, a contract for the sale and purchase of a product or products will come into force between the buyer and seller and accordingly you commit to buying or selling the relevant product or products upon the buyer’s confirmation of purchase through the marketplace;

• Products must be of satisfactory quality fit and safe for any purpose specified in and conform in all material respects to the product listing and any other description of the products supplied or made available by the seller to the buyer;

• You are responsible for reading the full item listing before committing to buy;

• The price for a product will be as stated in the relevant product listing. It also includes all taxes and comply with applicable laws in force from time to time;

• Delivery charges, packaging and handling charges, insurance costs other subordinate costs and charges where applicable will only be payable by the buyer if this is clearly stated in the product listing.

• When listing an item, you acknowledge and agree to provide contact information, a refund policy and order fulfillment timelines on your Mubbi e-shop.

6. PAYMENTS

7. PAYMENT TERMS
